Portfolio & Case Study Policy

1. Introduction

This Portfolio & Case Study Policy explains Grey Collective Inc.’s (“Grey Collective”, “we”, “us” or “our”) rights regarding the display and publication of completed projects for portfolio, marketing and business development purposes.

This Policy forms part of our Terms and Conditions and applies to every Client unless otherwise agreed in writing.

2. Purpose

Grey Collective invests significant time, expertise and creativity into every project it undertakes.

The ability to showcase completed work is an important part of demonstrating our experience, design capabilities and professional standards.

Accordingly, Grey Collective reserves the right to display completed Projects in accordance with this Policy.

3. Portfolio Rights

Unless otherwise agreed in writing before commencement of a Project, Grey Collective may publicly display completed Projects for legitimate business purposes.

This may include:

  • completed websites;
  • website screenshots;
  • homepage designs;
  • internal pages;
  • branding;
  • logos supplied by the Client;
  • user interface designs;
  • user experience designs;
  • mobile views;
  • desktop views;
  • animations;
  • mock-ups;
  • before-and-after comparisons;
  • project summaries;
  • case studies;
  • design processes;
  • publicly available website content.

4. Marketing and Promotional Use

Grey Collective may use completed Projects for:

  • portfolio presentations;
  • marketing materials;
  • social media;
  • business proposals;
  • award submissions;
  • speaking engagements;
  • presentations;
  • printed materials;
  • digital advertising;
  • promotional campaigns;
  • educational purposes;
  • internal training.

5. Client Identification

Grey Collective may identify a Client by using:

  • the business name;
  • trading name;
  • publicly available logo;
  • publicly available branding;
  • publicly available website;
  • publicly available project information.

Grey Collective will not publish confidential or private information unless expressly authorised in writing.

6. Confidential Projects

Grey Collective respects the confidentiality of its Clients.

Where a Project is confidential or subject to a non-disclosure agreement, Grey Collective shall not publish or disclose confidential information except where:

  • authorised in writing by the Client;
  • required by law;
  • required by a court or regulatory authority.

7. Confidentiality Requests

A Client who does not wish their completed Project to appear in Grey Collective’s portfolio must notify Grey Collective in writing before the Project commences.

Grey Collective reserves the right to accept or reject such requests at its sole discretion.

Where confidentiality is agreed in writing, Grey Collective shall comply with the agreed confidentiality obligations.

8. Intellectual Property

Nothing contained in this Policy transfers ownership of any intellectual property.

Ownership of Deliverables shall remain subject to the applicable Terms and Conditions and any written agreement between Grey Collective and the Client.

Grey Collective retains ownership of its proprietary methodologies, design systems, reusable components, frameworks, templates, source code libraries, automation systems, workflows and other proprietary intellectual property.

9. Publicly Available Information

Grey Collective may reproduce screenshots or references to websites that have already been publicly launched and made available by the Client.

Grey Collective shall not be responsible for subsequent modifications made by the Client or third parties after publication.

10. Removal Requests

Grey Collective may, at its sole discretion, consider reasonable written requests to remove a Project from its portfolio.

Grey Collective shall not be obliged to remove any Project unless required by law or otherwise agreed in writing.

Removal of a Project from Grey Collective’s portfolio shall not affect any other rights arising under the Terms and Conditions.

11. Accuracy

Grey Collective endeavours to ensure that all portfolio material accurately represents completed Projects.

However, portfolio images, mock-ups or case studies may be edited, resized, cropped or adapted for presentation purposes provided that the overall representation of the Project remains fair and accurate.

12. Reservation of Rights

Grey Collective expressly reserves all rights relating to the publication, display and promotion of completed Projects except where expressly limited by written agreement.

Failure by Grey Collective to exercise any right under this Policy shall not constitute a waiver of that right.

13. Changes to this Policy

Grey Collective reserves the right to amend this Portfolio & Case Study Policy at any time.

Any revised version shall become effective upon publication.

14. Governing Law

This Portfolio & Case Study Policy shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Nothing contained in this Policy limits any mandatory legal rights that cannot lawfully be excluded under applicable legislation.
